New form to request decision review

In an effort to ensure speedy processing, the Indian Residential Schools Adjudication Secretariat is introducing a new form for use by counsel who wish to request a review of a decision made under the Independent Assessment Process.

There are two grounds on which counsel can request that an adjudicator's decision be reviewed:

  • If the adjudicator, or reviewing adjudicator, did not properly apply the IAP model to the facts as found by the adjudicator; and
  • If the adjudicator’s decision contains a palpable and overriding error.

The grounds on which the review is being requested much be indicated on the form. In addition, counsel must provide a short written statement describing their objections to the decision. Please limit your statement to no more than 1,500 words.

Counsel is expected to use the form when requesting a review. Failure to do so could lead to delays in processing your request.

The form can be downloaded below. Once it is complete, please submit it to the Secretariat via Electronic Document Interchange, or mail it to the Secretariat at the address listed on the form.
