IAP Application to Standard Track

Were you sexually or physically abused? (Please read the chart on page 13 of the IAP Guide to learn about the acts of abuse that are compensated in the IAP.) If so, your Application will be admitted to the Standard Track. Claimants are urged to retain counsel to proceed through the Standard Track.

Full Hearing ...

You can tell your whole story to an Adjudicator. You can explain the abuse, as well as any potential harms, aggravating factors, loss of opportunity or needs for future care that you may have.

POI or Witness Hearing

You do not have to meet the person that abused you. The Adjudicator will meet Persons of Interest (POI) separately. Also, witnesses who are requested to explain what they know about the abuse are met with separately by the Adjudicator.

Expert/Medical Assessment…

You may need to meet with a medical expert or other expert. In the Standard Track this occurs if requested by the Adjudicator. The Adjudicator will obtain and consider the expert assessments.

Decision

The Adjudicator considers all information and writes a decision describing the conclusion and how he or she reached it.

IAP Application to Complex Track

Are you claiming Actual Income Loss or Other Wrongful Acts? (Please read page 18 of the IAP Guide for information on Actual Income Loss, and page 24 of the IAP Guide for information on Other Wrongful Acts.) If so, your Application will be admitted to the Complex Track. Claimants are urged to retain counsel to proceed through the Complex Track.

Full Hearing…

You can tell your whole story to an Adjudicator. You can explain the abuse, as well as any potential harms, aggravating factors, loss of opportunity (LOO), actual income loss (AIL), or needs for future care that you may have. Claimants may choose to seek compensation for either LOO or AIL, but not both.
