Notice - ADR Re-opened claims - January 20, 2009

Former students who settled their Indian residential schools abuse claims in the Alternative Dispute Resolution (ADR) process after May 30, 2005 may be eligible to apply to re-open in the Independent Assessment Process ( IAP ).

The opportunity to apply to re-open a settled ADR claim is available to former students with one or both of the following types of claim:

  1. Former students who were compensated in ADR for Loss of Opportunity at the highest level – level 3;
  2. Former students who experienced sexual abuse by another residential school student at the highest level – level SL4 or SL5 (please see the IAP application guide).

Loss of Opportunity

Former students compensated in ADR for Loss of Opportunity – level 3 and who signed a release after May 30, 2005, can apply to the IAP to have their claims re-evaluated so that the assignment of points may be reconsidered using the IAP standards to see if they are entitled to receive another payment.

Student on Student

Former students who experienced sexual abuse by another residential school student at the SL4 or SL5 level (please see the IAP application guide) which was not compensated in ADR and who signed a release after May 30, 2005, can apply to the IAP to have their claims re-evaluated using the IAP standards to see if they are entitled to receive another payment.

The sexual abuse suffered by another student can be compensated in the IAP only if it was the most serious abuse that was experienced at the Indian residential school.

When completing the SOS re-opener application form please do not re-write the abuse event if it was already described in ADR. Please indicate in the application form that the abuse was already described in ADR if this is the case. If it was not described fully in ADR, a completed SOS re-opener application will be required.

Due to the complexities involved with the Student on Student re-opener process, it is recommended that former students speak with a lawyer.
